Terms of Service
These Terms of Service govern your use of the castara.io website and any services provided by castara.io, a brand of Bessen International LLC, located at 1001 S Main Street, Ste 249, Kalispell, MT 59901, United States. By accessing our website or purchasing our services, you agree to be bound by these terms.
1. Services
Castara provides ADA-focused Website as a Service (WaaS) solutions for healthcare providers, medical spas, and local businesses. Services may include website design, development, hosting, accessibility implementation, accessibility monitoring, maintenance, content updates, deployment, and related website management services. Specific deliverables, pricing, and service limits are described on castara.io and may be updated from time to time.
- Hand-coded HTML/CSS/JS websites with no page builder dependencies
- Performance-first builds targeting 100 PageSpeed scores
- CRO audits, A/B testing, and conversion funnel analysis
- ADA / WCAG 2.2 AA compliant builds for US local businesses
- Hosting, deployment, and ongoing maintenance as agreed per project
2. Setup Fees
Setup fees are one-time implementation charges covering website creation, accessibility implementation, onboarding, deployment, configuration, certification, project management, and related work required to launch the Client's website. Setup fees become non-refundable once work has commenced.
3. Subscription Billing
Castara offers both monthly and annual subscription plans. Monthly subscriptions are billed in advance and renew automatically each month until cancelled. Annual subscriptions are billed in advance for a twelve (12) month term and renew automatically for successive annual terms unless cancelled in accordance with these Terms.
The Standard Plan currently includes:
- Managed hosting
- Accessibility monitoring
- Ongoing website maintenance
- Up to five (5) content update requests per month
- Ongoing compliance management
4. Cancellation and Refunds
Monthly subscriptions may be cancelled at any time by providing written notice to hq@castara.io. Cancellation becomes effective on the final day of the current billing month. Services will remain active until that date. Annual subscriptions may be cancelled at any time; however, cancellation becomes effective only at the end of the current annual term. Annual subscriptions remain active until the final day of the prepaid subscription year. All fees paid to Castara are non-refundable. No refunds, partial refunds, prorated refunds, credits, or reimbursements shall be provided for:
- Setup fees
- Monthly subscription fees
- Annual subscription fees
- Unused services
- Unused change requests
- Early cancellation of monthly or annual plans
Once a billing period or annual term has commenced, all associated fees are deemed fully earned and non-refundable. Upon termination or cancellation, Castara may suspend hosting, maintenance, monitoring, update services, and all other subscription-related services at the end of the active service term.
5. Client Responsibilities
The Client is responsible for:
- Providing accurate business information, content, branding assets, and approvals required for website development and maintenance.
- Ensuring all materials supplied to Castara may legally be used on the website.
- Reviewing and approving website content before publication.
- Consulting qualified legal counsel regarding any legal obligations applicable to their business.
The Client is solely responsible for the accuracy, legality, completeness, and ongoing maintenance of all content, claims, pricing, medical information, service descriptions, testimonials, images, and business information published on the website.
6. Change Requests
Standard subscriptions include up to five (5) reasonable content update requests per calendar month. Examples include:
- Text changes
- Image replacements
- Staff updates
- Service updates
- Business information changes
Requests involving new functionality, custom development, third-party integrations, additional pages, redesign work, or substantial scope changes may require additional fees or a separate agreement.
7. Intellectual Property and Website Buyout
The Client retains ownership of all business names, trademarks, logos, and content supplied by the Client. During an active subscription, Castara retains ownership of the underlying website code architecture, deployment infrastructure, accessibility audit documentation, hosting environment, monitoring systems, and proprietary development methodologies. The Client receives a non-exclusive license to use the website while subscription services remain active. At any time, the Client may request to purchase full ownership of the website and related assets through a one-time website buyout agreement. Website buyout pricing is determined individually based on the website, scope, assets involved, and the duration of the client relationship. Pricing is available upon request and shall be quoted separately by Castara. Unless a website buyout agreement has been executed and paid in full, all ownership rights described in this section remain with Castara.
8. Accessibility Compliance and Legal Disclaimer
Castara builds websites in accordance with WCAG 2.2 AA standards and industry-recognized accessibility best practices. However, Castara does not provide legal advice and does not guarantee immunity from ADA claims, demand letters, lawsuits, investigations, regulatory actions, settlements, or legal expenses of any kind. Accessibility compliance requirements, enforcement priorities, and legal interpretations may change over time and are outside Castara's control. Clients remain solely responsible for their legal compliance obligations and should consult qualified legal counsel regarding their specific risk profile.
9. Hosting and Third-Party Services
Castara utilizes third-party infrastructure providers, hosting vendors, DNS providers, software services, and related technology partners. Castara shall not be liable for interruptions, outages, delays, security incidents, data loss, or service disruptions caused by third-party providers or events beyond our reasonable control.
10. Limitation of Liability
To the maximum extent permitted by law, Castara and Bessen International LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. Castara's total aggregate liability arising from any claim shall not exceed the total subscription fees paid by the Client during the three (3) months immediately preceding the event giving rise to the claim.
11. Modifications
Castara reserves the right to modify these Terms at any time. Material changes will be published on this page and may be communicated to active clients by email. Continued use of Castara services following such changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by the laws of the State of Montana, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Flathead County, Montana.

Privacy Policy
This Privacy Policy describes how castara.io, a brand of Bessen International LLC, collects, uses, and protects information when you visit castara.io or engage with our services. We are committed to handling your data with transparency and care.
1. Information We Collect
Information you provide directly: When you fill out our contact form, we collect your name, business name, email address, website URL, phone number, and any details you include in your message.
Automatically collected data: Our hosting infrastructure may collect standard server logs including IP addresses, browser type, referring URLs, and pages visited. This data is used for security and performance monitoring only.
Analytics and marketing: With your consent, we use Google Analytics 4 to understand site usage, and marketing tools such as Apollo and (where enabled) the Meta Pixel to measure and improve our outreach. These run only after you opt in via our cookie banner. You can change or withdraw consent at any time using the “Cookie Preferences” link in our footer.
2. How We Use Your Information
Information you provide is used solely to:
- Respond to your enquiry or project request
- Deliver and manage the services you purchase
- Send service-related communications such as invoices and project updates
- Improve our service offering based on aggregate feedback
We do not sell, rent, or trade your personal information to third parties for marketing purposes. California residents: you have the right to opt out of any “sale” or “sharing” of personal information; you can exercise this through the “Cookie Preferences” control in our footer or by emailing us.
3. Third-Party Services
- Web3Forms — contact form submissions. Subject to Web3Forms' Privacy Policy.
- Google Analytics 4 — anonymised usage analytics, loaded only with consent. Subject to Google's Privacy Policy.
- Apollo.io — marketing analytics, loaded only with consent. Subject to Apollo's Privacy Policy.
- Meta — campaign measurement where enabled, loaded only with consent. Subject to Meta's Privacy Policy.
- GitHub — version control and code storage. Subject to GitHub's Privacy Statement.
- Vercel — hosting and deployment. Subject to Vercel's Privacy Policy.
castara.io is not responsible for the privacy practices of third-party services. We recommend reviewing their policies independently.
4. Data Retention
We retain your contact information for the duration of our business relationship and for up to 2 years following the end of your engagement. You may request deletion of your data at any time by contacting us at hq@castara.io. We will process deletion requests within 30 days.
5. Data Security
We take reasonable technical and organisational measures to protect your information from unauthorised access, loss, or disclosure. Client website data is version-controlled on GitHub with access restricted to authorised castara.io team members only.
6. Your Rights
Depending on your location, you may have the right to access the personal data we hold about you, request correction of inaccurate data, request deletion, object to or restrict processing, and request data portability. To exercise any of these rights, contact us at hq@castara.io.
7. Children
Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has submitted information to us, please contact us and we will delete it promptly.
8. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the updated policy.

Accessibility Statement
castara.io, a brand of Bessen International LLC, is committed to ensuring digital accessibility for people with disabilities. We actively work to improve the user experience for everyone and apply relevant accessibility standards to all websites we build and operate.
Conformance Status
The castara.io website aims to conform to the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA. WCAG 2.2 AA defines requirements to improve accessibility for people with disabilities — including those with visual, auditory, motor, cognitive, and other disabilities.
